Terms of Service

These terms govern your use of Digital Assault AI. By creating an account, starting a trial, or purchasing a membership, you agree to them. The short version: we give you wholesale access to a stack of marketing platforms and tools, you pay a membership fee to keep using the paid ones, and either side can end the arrangement.

Who we are

Digital Assault AI ("we," "us") is a DBA of Performance Digital Marketing LLC, operating digitalassault.ai from Meridian, Idaho. These terms are a legal agreement between you and Performance Digital Marketing LLC.

What we provide

Digital Assault AI is a membership that gives you access, at wholesale pricing, to third-party marketing platforms and tools — including GoHighLevel, Vendasta and deal.ai — together with additional applications we make available through your dashboard. Your access to each platform is governed both by these terms and by that platform's own terms of use.

Free trial

• New members may receive a 21-day free trial that includes access to our included applications and the free tools offered through GoHighLevel and Vendasta, or whichever items we designate as free.
• The trial does not require a credit card.
• Paid applications and paid third-party products are not unlocked during the trial. Activating them requires an active, paid Digital Assault AI membership.
• If you do not purchase a membership by the end of the 21-day trial, your access ends and your account may be closed. Your contact record may be retained for follow-up unless you ask us to delete it.

Membership, fees & activation

• Current membership pricing is listed on digitalassault.ai. Fees are billed monthly, or annually where an annual option is offered.
• You must have a current, paid Digital Assault AI membership before any paid application or paid third-party product can be activated on your account.
• Some third-party products carry their own separate fees, charged in addition to your Digital Assault AI membership. Those charges are disclosed at the point of purchase.
• Unless stated otherwise, memberships renew automatically until cancelled.

Cancellation & refunds

You can cancel your membership at any time; cancellation stops future renewals and ends your access at the close of the current billing period. Any money-back guarantee we advertise applies as described on our site at the time of purchase. Third-party and add-on fees are governed by the applicable provider's refund policy.

Text messaging

If you provide your phone number, our messaging practices and your opt-out rights are described in our Privacy Policy. You can reply STOP to any message to opt out, or HELP for help.

Acceptable use

You agree to use the service and the platforms behind it lawfully, and not to: send unlawful, deceptive, or unsolicited messages; infringe others' rights; attempt to breach security or access accounts that aren't yours; resell or white-label access except as expressly permitted by your plan; or use the tools to harm others. We may suspend or terminate accounts that violate these terms or the terms of the underlying platforms.

Your content and accounts

You are responsible for the content you create, the contacts you upload, and the messages you send through the platforms, and for having the necessary consents to do so. You retain ownership of your content; you grant us the access needed to operate and support your account.

Third-party platforms

GoHighLevel, Vendasta, deal.ai and other providers operate their own systems and set their own terms, availability and pricing. We are not responsible for their outages, changes, or decisions, and continued access to any given platform may depend on our ongoing relationship with that provider.

Disclaimers & limitation of liability

The service is provided "as is," without warranties of any kind. We don't guarantee specific results, uninterrupted availability, or that every tool will fit your needs. To the fullest extent allowed by law, Performance Digital Marketing LLC is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the three months before the claim.

Changes & governing law

We may update these terms; we'll post changes here with a new "last updated" date, and continued use means you accept them. These terms are governed by the laws of the State of Idaho, USA.
